These terms of use tell you the terms on which you may use our website at abex.capital (our site).
By using our site, you confirm that you accept these terms and agree to comply with them. If you do not agree, you must not use our site.
Who we are
Our site is operated by ABEX Capital Limited, a company registered in England and Wales (company number 14607492) whose registered office is at Mutual House, 4th Floor, 70 Conduit Street, London W1S 2GF (we, us, our). ABEX Capital Limited is a holding company and carries on no regulated activity.
ABEX is a group brand. The regulated activities described on our site are carried on by specific companies, not by the group as a whole:

Who our site is for
Our site is for professional clients and eligible counterparties only, within the meaning of Chapter 3 of the FCA’s Conduct of Business Sourcebook. It is not directed at retail clients, and no ABEX company provides services to retail clients.
By using our site you confirm that you are a per se or elective professional client, or a per se or elective eligible counterparty. That confirmation is a statement about your own status. It is not a client categorisation by any ABEX company and has no effect for the purposes of any service — categorisation is carried out separately at onboarding.
If you are a retail client or a consumer, please do not use our site or rely on anything on it.
Our site is directed at persons accessing it from the United Kingdom. It is not directed at any person in any jurisdiction where its publication or availability would breach local law or regulation, or would require an ABEX company to hold a registration it does not hold there. In particular, nothing on our site is an offer or solicitation in the United States, to any US Person, or in any member state of the European Union. If you access our site from outside the United Kingdom you do so on your own initiative and are responsible for compliance with your local law.
Other terms that apply
These terms refer to our Privacy Notice, which explains how we process personal data, and our Disclaimer and Regulatory Information, which sets out our regulatory status in full. Both form part of these terms.
These terms govern your use of our site only. They do not govern any service an ABEX company provides to you as a client. Any such service is governed by your separate written agreement with that company, which prevails over these terms in respect of that service.
Changes
We may revise these terms at any time by amending this page, and the revised version takes effect when posted. Please check this page from time to time, as the current version is binding on you.
We may also update our site and change its content at any time. Content may be out of date at any given time and we are under no obligation to update it.
Accessing our site
Our site is made available free of charge and on a temporary basis. We do not guarantee that it, or any content on it, will always be available, uninterrupted or free from errors or omissions. We may suspend, withdraw, discontinue or change all or part of the site without notice, and we will not be liable if it is unavailable at any time or for any period.
You are responsible for making the arrangements necessary to access our site, and for ensuring that everyone who accesses it through your internet connection is aware of these terms and complies with them.
No offer, no advice
The content on our site is provided for general information only. It is not an offer to sell or a solicitation of an offer to buy any financial instrument, cryptoasset or other investment, and it is not investment, legal, tax, accounting or regulatory advice or a personal recommendation.
Nothing on our site forms the basis of, or may be relied on in connection with, any contract. You should obtain your own professional advice and conduct your own investigation before taking, or refraining from, any action.
No reliance on information
Although we make reasonable efforts to keep our site up to date, we make no representation, warranty or guarantee, express or implied, that its content is accurate, complete, fair or current.
Any description of our technology, algorithms, execution methodology or research is a general summary. It is not a specification and creates no contractual commitment. Any statement about past or expected performance, execution quality or cost improvement is illustrative only; past performance is not a reliable indicator of future results.
Anyone who acts, or changes their position, in reliance on the content of our site does so entirely at their own risk.
Risk
All investments, including cryptoassets and derivatives referencing cryptoassets, carry a high degree of risk. Risks include price volatility, regulatory change, cybersecurity threats, technology and infrastructure failure, liquidity constraints, fraud, operational disruption, changes to underlying blockchain protocols or smart contracts, and the failure of third-party banking, safekeeping, custody or payment providers. The value of your investments may fall as well as rise, may fall significantly, and you may lose everything you invest. Derivatives may produce losses exceeding the amount deposited. Our site does not identify all of the risks of any transaction, product or instrument referred to on it.
ABEX UK Derivatives Limited provides services only to eligible counterparties and professional clients. Clients in those categories will generally not be eligible to refer a complaint to the Financial Ombudsman Service and will generally not be eligible claimants under the Financial Services Compensation Scheme. Eligibility for both is determined by the FCA’s rules rather than by client categorisation, and is assessed individually; your position is confirmed in your client documentation.
The Financial Ombudsman Service and the Financial Services Compensation Scheme do not apply to the cryptoasset business carried on by ABEX Capital UK Limited.
Intellectual property
We are the owner or licensee of all intellectual property rights in our site and in the material published on it, including the ABEX name and logo. Those rights are protected by laws and treaties worldwide, and all of them are reserved.
You may view, download and print extracts of our site for your own internal reference. You must not otherwise copy, reproduce, republish, distribute, transmit, adapt, frame or commercially exploit any part of it without a licence from us, and you must not remove any copyright, trade mark or other proprietary notice.
Acceptable use
You must use our site only for lawful purposes. You must not:
use it for any unlawful, fraudulent or harmful purpose, or in a way that damages our reputation or that of any third party;
impersonate anyone, or imply an association with ABEX where none exists;
attempt to gain unauthorised access to our site, its server, or any connected system, or otherwise penetrate our security;
introduce any virus, trojan, worm, logic bomb, spyware or other malicious material, or launch a denial-of-service attack;
use any robot, spider or scraper to access, monitor or copy our site without our written consent;
reverse engineer or decompile any software available through our site; or
use our site to send unsolicited advertising or promotional material.
Breach of this section may be a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant authorities and co-operate with them, including by disclosing your identity. We may suspend or terminate your access to our site at any time, and will do so immediately on any breach of this section.
Personal data and cookies
We process personal data in accordance with our Privacy Notice, which explains what we collect, why, and what rights you have.
Our site does not use cookies, analytics, advertising or tracking technologies. It stores a small amount of information in your browser where that is strictly necessary to provide what you have asked for — remembering your scroll position as you move between pages, and keeping you signed in on our client platform. No page on our site loads content from any other company, so your browser does not connect to a third party when you use it. Our Privacy Notice sets all of this out, including how long each item is kept.
If we introduce anything that is not strictly necessary, we will update our Privacy Notice and put a consent mechanism in place first.
Malware and security
We do not guarantee that our site will be secure or free from bugs or malware. You are responsible for configuring your own technology to access it and for using your own malware protection.
The internet is not a secure transmission medium. We accept no liability for transmission errors, or for the security or confidentiality of anything sent to or from us across the internet.
Information you send us
If you contact us through our site, you confirm that you are entitled to send us the material and that it is accurate and not unlawful or in breach of anyone’s rights.
Unless we have agreed a confidentiality undertaking with you in writing, we cannot treat information you send through our site as confidential. Please do not send confidential, price-sensitive or special category personal data to us by email or through any form on our site. To discuss a potential engagement, email info@abex.capital and we will put appropriate arrangements in place.
Third-party links
Our site may contain links to other sites and resources provided by third parties. Those links are for your information only. We have no control over their content, have not reviewed it, and accept no responsibility for it or for any loss arising from your use of it. A link does not imply endorsement.
You may link to our home page provided you do so fairly and lawfully, do not damage our reputation or take advantage of it, and do not suggest any association or endorsement where none exists. You must not frame our site. We may withdraw linking permission at any time.
Limitation of our liability
Nothing in these terms excludes or limits our liability for death or personal injury arising from our negligence, for fraud or fraudulent misrepresentation, for breach of any duty owed under the regulatory system to the extent that liability cannot lawfully be excluded, or for any other liability that cannot be excluded or limited under English law.
To the extent permitted by law, we exclude all conditions, warranties, representations and other terms that might apply to our site or its content, whether express or implied.
We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, even if foreseeable, arising out of or in connection with use of, or inability to use, our site, or use of or reliance on any content on it.
Because our users are business users, we will not in particular be liable for loss of profits, revenue or anticipated savings, trading losses, business interruption, loss of business, loss of goodwill, loss or corruption of data, or any consequential, punitive, special or indirect loss, even if we have been advised of the possibility.
We will not be liable for loss or damage caused by a virus, denial-of-service attack or other technologically harmful material that infects your equipment, programs or data as a result of your use of our site or your downloading of any content from it, or from any site linked to it.
Nothing in this section affects any liability of an ABEX company arising under a separate written agreement for services.
Indemnity
You agree to indemnify ABEX, its affiliates, and their officers, employees and agents against all claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of your breach of these terms or your use of our site.
Complaints
Complaints should be sent to info@abex.capital, or to the registered office address above, marked for the attention of the Compliance function. Complaints relating to the business of ABEX UK Derivatives Limited are handled under its complaints procedure, a summary of which is available on request.
General
If any provision of these terms is found to be unlawful, invalid or unenforceable, it will be severed and the remaining provisions will continue in force. Any delay or failure by us to enforce a provision is not a waiver of it.
A person who is not a party to these terms has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce them, except that each ABEX company may enforce the sections headed Intellectual property, Acceptable use, Limitation of our liability and Indemnity.
Applicable law
These terms, their subject matter and formation, and any non-contractual disputes or claims arising out of them, are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
